USCIS Reduces EAD Validity Periods and Increases Background Screening

New USCIS policy reduces EAD duration and strengthens work authorization verification procedures.

Effective: December 5, 2025


USCIS has announced new policies that shorten the validity period of Employment Authorization Documents (EADs) and increase the frequency of background checks for several categories of foreign nationals. These changes aim to strengthen security screening and prevent fraud.


Key Changes

USCIS will now limit EAD validity for certain applicants from 5 years to 18 months, including individuals who:


  • Were admitted as refugees

  • Were granted asylum

  • Were granted withholding of removal

  • Have pending asylum or withholding applications

  • Have pending adjustment of status under INA 245

  • Have pending cancellation of removal, suspension of deportation, or NACARA cases


These updates apply to all Form I-765 applications filed or pending on or after December 5, 2025.


Changes Required by HR 1 (Federal Law)

Under HR 1, EAD validity will be limited to one year or the duration of parole/TPS (whichever is shorter) for:

  • Refugee parolees

  • TPS recipients

  • Individuals granted parole

  • Applicants with pending TPS

  • Paroled spouses of entrepreneurs


This applies to applications pending or filed on or after July 22, 2025.


Impact on Applicants

Foreign nationals in the affected categories will need to renew EADs more frequently and may experience additional security vetting during processing.
